Evolving media regulations: National and EU-wide regulatory frameworks for social media platforms in relation to their role as media distributors

In the current period of rapid changes in digital technologies, the regulatory landscape for social media has become a critical concern for legislatures across Europe. The recent ReMeD project report has made a comprehensive survey of the European and national regulations impacting social media platforms in eight European countries. Their analysis reviews the regulatory frameworks and diverse approaches adopted by different states to balance freedom of expression with public interest protections.

National regulations for social media platforms across Europe exhibit significant variability. While EU-wide laws form the backbone of media regulations in many countries, national legislations address specific areas such as advertising, hate speech, and data protection. For example, Spain and Belgium primarily follow EU-wide regulations, whereas the United Kingdom and Ireland have enacted specific laws like the Online Safety Bill and the Online Safety and Media Regulation Act, respectively. These laws ensure compliance with EU directives and introduce stringent measures to safeguard users and regulate content.

Media legislation plays an essential role in fostering a democratic and resilient media landscape in Europe, ensuring transparency, promoting pluralism, and safeguarding the quality of information across platforms. The ReMeD report emphasizes that despite varied national approaches, the overarching goal remains to obtain a balance between protecting freedom of expression and upholding public interest. This balance facilitates combating misinformation and disinformation, such as that which surged during the crises of the COVID-19 pandemic and the Russian war in Ukraine.

Different countries have adopted unique strategies to address the protection of sexual minorities and counter disinformation. While in the Czech Republic, Belgium, Ireland, Norway, Spain and the United Kingdom general anti-hate speech legislation and measures against discrimination are established, Germany and Austria have even enacted specific laws to regulate harmful online content and ensure the adequate representation of minorities in media. These measures seek to advance more inclusive and equitable digital environments.

The regulation of artificial intelligence (AI) in media is presently at an embryonic stage. While the EU Commission’s proposal for AI regulation emphasizes ethical considerations and transparency, individual countries are still developing their own guidelines and policies. Germany focuses on competitive and responsible AI development, while the Czech Republic aims to encourage innovative development through its National Artificial Intelligence Strategy. The UK’s AI strategy plans to lead globally in AI governance, emphasizing safe and ethical AI development.

The report highlights variations in national approaches to media regulation and shows how countries are shaping policies to address the challenges posed by digital transformations to protect democratic values while promoting technological innovation. This dynamic and fluid regulatory landscape involves continuous adaptation to emerging challenges to ensure that media regulations remain robust and responsive.
